These Terms of Service (“Terms”) govern your use of airqio™ monitors, firmware, mobile applications, websites, cloud services, Commercial dashboards, telemetry services, and related products and services (collectively, the “airqio™ Services”).
airqio™ is owned and operated by BigWindow LLC, a Pennsylvania limited liability company (“BigWindow,” “we,” “us,” or “our”).
By using the airqio™ Services, you agree to these Terms. If you use airqio™ on behalf of a company, organization, or other entity, you represent that you have authority to use the Services on its behalf and, where applicable, to bind that organization to these Terms.
1. airqio™ Services
airqio™ provides devices and software for measuring, displaying, storing, analyzing, and managing air quality and related environmental information.
The airqio™ system may include:
- airqio™ monitoring hardware;
- sensors and embedded firmware;
- Bluetooth Low Energy (“BLE”) communication;
- Wi-Fi and Internet connectivity;
- the airqio™ mobile application;
- airqio™ websites;
- airqio™ cloud infrastructure;
- data ingestion and storage services;
- firmware and OTA update services;
- diagnostic services; and
- the airqio™ Commercial web dashboard.
Features may vary according to monitor model, firmware, configuration, service offering, subscription, and operating mode.
2. Operating Modes
Local Mode
Local mode is designed to operate without Internet access. Air quality information is stored and accessed locally, including through a compatible airqio™ mobile application using BLE.
Internet-dependent features, remote diagnostics, cloud telemetry, remote dashboard access, and OTA services are unavailable in Local mode.
Residential Mode
Residential mode allows an airqio™ monitor to communicate with airqio™ Internet services for functions including:
- time synchronization;
- OTA firmware updates;
- device maintenance and configuration; and
- remote operational and diagnostic access, including access to monitor sensors and their reported values.
Sensor values may therefore be accessed or transmitted when necessary for diagnostics and support. Residential mode does not include continuous Commercial time-series telemetry storage or access to the Commercial organizational dashboard.
Commercial Mode
Commercial mode includes applicable Residential connectivity and diagnostic features and additionally transmits time-series monitor telemetry to airqio™ cloud infrastructure.
Authorized users may view, analyze, export, manage, and, where supported, delete Commercial telemetry through the airqio™ Commercial web dashboard and other supported Services.
Commercial services are provided on a recurring subscription or service-fee basis and remain subject to the applicable subscription, service plan, order, or other Commercial agreement.
3. Accounts
Certain airqio™ Services require an account.
You are responsible for:
- providing accurate account information;
- maintaining the confidentiality of account credentials;
- restricting unauthorized access to your account;
- promptly notifying us of suspected unauthorized access; and
- activities performed through your account to the extent permitted by applicable law.
You may not impersonate another person or organization or attempt to gain unauthorized access to another airqio™ account, monitor, organization, or installation.
4. Commercial Organizations and Users
Commercial airqio™ installations may contain multiple users, sites, buildings, areas, and monitors.
An organization may designate administrators who can manage monitors, users, roles, permissions, configuration, alerts, telemetry, and access to organizational data.
If your airqio™ account is provided or managed by an employer or other organization, that organization’s administrators may be able to create, modify, suspend, or terminate your access and may have access to information associated with the organization’s airqio™ installation.
The organization is responsible for determining who should have access to its airqio™ system and for maintaining appropriate user permissions.
5. Commercial Subscriptions and Fees
Commercial cloud, telemetry, dashboard, and related services require payment of applicable recurring subscription or service fees.
Subscription pricing, billing periods, included features, monitor quantities, data retention, and other service terms may be specified at purchase, in an order, service plan, invoice, quotation, or separate written agreement.
Failure to pay applicable fees may result in suspension or termination of Commercial cloud services, telemetry ingestion, dashboard access, or other subscription-dependent functionality.
Unless otherwise stated in the applicable service agreement, termination or expiration of Commercial services does not transfer ownership of airqio™ software, cloud services, or other BigWindow LLC intellectual property.
Termination of Commercial cloud services does not necessarily prevent compatible hardware from continuing to operate using supported non-Commercial or local functionality.
6. Commercial Telemetry Retention, Export, and Deletion
Unless a different retention period is specified in the applicable Commercial service offering or written agreement, the default retention period for Commercial time-series telemetry is two years.
Commercial customers may export telemetry using supported airqio™ export features during the applicable retention period.
Authorized users may delete Commercial telemetry using supported airqio™ features. Customers are responsible for exporting information they wish to preserve before deleting it or before expiration of its retention period.
Deletion may be irreversible.
Expired or deleted telemetry may remain temporarily in backups, disaster-recovery systems, logs, or other protected storage until those systems are overwritten or cycled according to normal operational procedures.
BigWindow LLC may retain information when required by law or reasonably necessary for security, fraud prevention, dispute resolution, or enforcement of agreements.
airqio™ is not intended to serve as the sole archival repository for records that a customer is legally, contractually, or operationally required to preserve.
7. Environmental Measurements and Sensor Limitations
airqio™ is designed to provide information about air quality and environmental conditions. Measurements may include particulate matter, gases or gas-related measurements, temperature, humidity, and other environmental parameters.
All sensor systems have limitations.
Measurements may be affected by factors including:
- sensor tolerances and aging;
- calibration;
- monitor placement;
- airflow;
- temperature and humidity;
- interfering substances;
- contamination;
- environmental conditions;
- power interruptions;
- firmware or software errors;
- network or communications failures; and
- hardware failure.
BigWindow LLC does not warrant that airqio™ measurements will always be complete, accurate, continuous, timely, or representative of conditions throughout a room, building, facility, or other area.
8. Not a Medical or Life-Safety Device
Unless expressly identified otherwise in written documentation provided by BigWindow LLC, airqio™ is not a medical device, emergency warning system, fire or smoke alarm, carbon monoxide alarm, occupational safety instrument, or life-safety system.
airqio™ information is provided for environmental monitoring and informational purposes.
You should not rely solely upon airqio™ to identify or warn of conditions presenting an immediate threat to health or safety.
airqio™ measurements and recommendations do not constitute medical advice. Questions regarding health conditions, symptoms, exposure limits, workplace safety requirements, or medical decisions should be addressed to appropriately qualified professionals.
Required safety devices, alarms, ventilation systems, occupational monitoring equipment, or other protective systems should not be replaced by airqio™ unless expressly authorized for that purpose.
9. Internet, Wireless, and Cloud Services
Some airqio™ features depend upon BLE, Wi-Fi, local networks, Internet connectivity, third-party infrastructure, cloud computing services, DNS, telecommunications providers, mobile operating systems, or other technologies outside BigWindow LLC’s direct control.
Accordingly:
- communications may occasionally fail;
- monitor data may be delayed or unavailable;
- telemetry may contain gaps;
- notifications or alerts may be delayed or not delivered;
- a monitor may temporarily appear offline;
- cloud services or dashboards may be unavailable; and
- historical information may be incomplete.
BigWindow LLC does not guarantee uninterrupted or continuous operation of Internet, wireless, cloud, dashboard, telemetry, notification, diagnostic, or remote-access services.
10. Data and Telemetry
In Commercial mode, airqio™ receives and stores time-series environmental measurements and related monitor information.
You acknowledge that telemetry can be lost, delayed, duplicated, corrupted, or unavailable because of power loss, equipment failure, storage failure, network interruption, Internet connectivity, software defects, maintenance, or other causes.
Customers requiring independent archival records are responsible for exporting and maintaining appropriate copies.
11. Firmware and Software Updates
BigWindow LLC may provide firmware, mobile application, dashboard, server, or other software updates.
Updates may:
- correct defects;
- improve security;
- change functionality;
- add or remove features;
- modify sensor processing;
- change communication protocols;
- improve compatibility; or
- otherwise modify operation of the airqio™ Services.
Internet-connected Residential and Commercial monitors may receive OTA firmware updates where supported.
Updates may temporarily interrupt service, and older versions of firmware, applications, or software may eventually cease to be supported.
12. Alerts and Notifications
Where airqio™ provides configurable alerts, warnings, emails, push notifications, dashboard indicators, or similar functions, those functions are supplemental informational tools only.
Delivery is not guaranteed.
Alerts may be delayed, missed, duplicated, or inaccurate because of sensor, device, network, Internet, cloud, software, configuration, or third-party service conditions.
airqio™ alerts must not be used as a substitute for legally required or appropriate life-safety, occupational safety, medical, fire, smoke, carbon monoxide, or emergency warning systems.
13. Acceptable Use
You may not:
- use the airqio™ Services for unlawful purposes;
- attempt to gain unauthorized access to airqio™ systems or another customer’s monitors or data;
- interfere with or disrupt airqio™ servers, networks, devices, or Services;
- introduce malware or malicious code;
- circumvent authentication or security mechanisms;
- intentionally overload or abuse airqio™ infrastructure;
- use automated means to access the Services in a manner that materially interferes with their operation;
- reverse engineer airqio™ software except to the extent such restriction is prohibited by applicable law; or
- use the Services in a manner that infringes the rights of others.
14. Intellectual Property
The airqio™ name, software, firmware, website, dashboard, documentation, designs, graphics, and other airqio™ materials are owned by BigWindow LLC or its licensors and are protected by applicable intellectual property laws.
Purchase of an airqio™ monitor transfers ownership of the physical product but does not transfer ownership of airqio™ firmware, software, cloud software, trademarks, or other intellectual property.
Subject to these Terms, BigWindow LLC grants you a limited, non-exclusive, non-transferable license to use airqio™ software and firmware as necessary to use the Services.
15. Feedback
If you voluntarily provide ideas, suggestions, bug reports, or other feedback concerning airqio™, you grant BigWindow LLC permission to use that feedback without restriction or obligation to compensate you.
This provision does not transfer ownership of your Commercial telemetry or other customer data to BigWindow LLC.
16. Third-Party Products and Services
airqio™ may rely upon or interact with third-party hardware, operating systems, networks, application stores, cloud services, Internet providers, mobile devices, software libraries, payment processors, or other services.
BigWindow LLC is not responsible for failures or changes in independent third-party products or services outside its reasonable control.
17. Availability, Changes, and Discontinuation
airqio™ Services may change over time.
To the maximum extent permitted by applicable law and subject to any separate written agreement, BigWindow LLC may modify, suspend, replace, or discontinue features or Services.
We do not guarantee that any particular cloud service, dashboard feature, application feature, diagnostic capability, integration, or other Internet-based service will remain available indefinitely.
Where reasonably practicable, we will attempt to provide appropriate notice of material discontinuation of paid Commercial services.
Unless required by applicable law or a separate written agreement, BigWindow LLC is not responsible for losses resulting from modification, suspension, or discontinuation of a Service.
18. Suspension, Cancellation, and Termination
BigWindow LLC may suspend or terminate access to airqio™ Services when reasonably necessary because of:
- violation of these Terms;
- nonpayment of applicable fees;
- security threats;
- fraud or abuse;
- unlawful activity;
- risk to airqio™ systems or other users; or
- discontinuation of the applicable Service.
Customers may cancel Commercial subscription services according to the terms of the applicable service plan or agreement.
Cancellation or termination may result in loss of access to Commercial cloud services, dashboard functionality, and telemetry ingestion.
Customers are responsible for exporting telemetry they wish to retain before service termination or expiration of the applicable retention period.
Unless required by applicable law or expressly provided by the applicable service plan or written agreement, prepaid, accrued, or previously paid service fees are not refundable merely because a customer ceases using the Services before the end of a billing period.
19. Privacy
Use of the airqio™ Services is also subject to the airqio™ Privacy Policy, which explains how BigWindow LLC handles personal information, monitor information, telemetry, and related data.
20. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, EXCEPT FOR ANY EXPRESS WRITTEN PRODUCT WARRANTY PROVIDED BY BIGWINDOW LLC, THE AIRQIO™ SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”
BIGWINDOW LLC DISCLAIMS ALL WARRANTIES NOT EXPRESSLY PROVIDED IN WRITING, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, AND CONTINUOUS OR ERROR-FREE OPERATION.
BIGWINDOW LLC DOES NOT WARRANT THAT AIRQIO™ MEASUREMENTS, TELEMETRY, ALERTS, SOFTWARE, CLOUD SERVICES, DIAGNOSTIC SERVICES, OR DASHBOARDS WILL BE ACCURATE, COMPLETE, UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.
Nothing in these Terms excludes warranties or rights that cannot lawfully be excluded.
21. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BIGWINDOW LLC AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, BUSINESS, USE, GOODWILL, OR DATA, ARISING FROM OR RELATED TO THE AIRQIO™ SERVICES.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BIGWINDOW LLC WILL NOT BE LIABLE FOR LOSS OR DAMAGE ARISING FROM:
- INACCURATE OR INCOMPLETE SENSOR MEASUREMENTS;
- FAILURE OR DELAY OF AN ALERT OR NOTIFICATION;
- LOST OR INCOMPLETE TELEMETRY;
- NETWORK, INTERNET, BLE, WI-FI, CLOUD, OR THIRD-PARTY SERVICE FAILURE;
- UNAVAILABILITY OF A DASHBOARD OR SERVICE;
- LOSS OF STORED DATA;
- FAILURE TO IDENTIFY AN ENVIRONMENTAL CONDITION; OR
- RELIANCE UPON AIRQIO™ AS A MEDICAL, EMERGENCY, OCCUPATIONAL SAFETY, OR LIFE-SAFETY SYSTEM.
TO THE EXTENT A LIMITATION OF TOTAL LIABILITY IS PERMITTED BY APPLICABLE LAW, BIGWINDOW LLC’S AGGREGATE LIABILITY ARISING FROM OR RELATING TO THE AIRQIO™ SERVICES WILL NOT EXCEED THE AMOUNT PAID TO BIGWINDOW LLC FOR THE AIRQIO™ SERVICE GIVING RISE TO THE CLAIM DURING THE THREE MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY.
Some jurisdictions do not permit certain warranty exclusions or limitations of liability, so some of these provisions may not apply to you.
22. Indemnification
To the extent permitted by applicable law, you agree to indemnify and hold harmless BigWindow LLC from third-party claims, liabilities, damages, and reasonable expenses arising from your unlawful use of the airqio™ Services, your material violation of these Terms, or your infringement of another person’s rights.
This section does not apply to the extent a claim results from BigWindow LLC’s own conduct for which liability cannot lawfully be excluded.
23. Governing Law
These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-law principles, except where applicable law requires otherwise.
To the extent permitted by law, disputes arising from these Terms or the airqio™ Services shall be brought in the appropriate state or federal courts having jurisdiction in Lancaster County, Pennsylvania.
24. Changes to These Terms
We may update these Terms to reflect changes in airqio™ products, Services, business practices, subscriptions, or applicable law.
When material changes are made, we will update the effective date and may provide additional notice through the airqio™ website, mobile application, Commercial dashboard, email, or another appropriate method.
25. Severability
If any provision of these Terms is found unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in effect.
26. Entire Agreement
These Terms, the airqio™ Privacy Policy, any applicable product warranty, subscription or service terms, and any separate written agreement between you and BigWindow LLC constitute the applicable agreement concerning your use of the airqio™ Services.
If a separate written Commercial agreement expressly conflicts with these Terms, the separate written agreement controls to the extent of that conflict.
